Successful Early Resolution
Several timely resolutions show our approach and the benefits for our clients:
Class action dismissed. Our attorneys negotiated a plaintiff’s voluntary dismissal of his already-filed wage and hour class action without payment by our client. Plaintiff dismissed before our client answered and before any application for class certification. Wage and hour class actions have been a bane of employers in recent years with Microsoft, Allstate, and many other prominent businesses paying dearly to settle following class certification. We counseled early disclosure and negotiation to persuade plaintiff’s law firm that it had filed a class action it wouldn’t win.
Employment claim resolved. Christa & Jackson represented another employer in resolving a former officer’s wrongful termination claims before suit had even been filed. Responding immediately to a pre-suit demand letter, our client was able to avoid disruptive and time-consuming discovery, trial preparation and trial by reaching a beneficial, quick settlement.
Misappropriation recovery achieved. Potential plaintiffs also benefit from immediate resolution. Christa & Jackson represented a former Olympic gold medalist whose likeness and fame had been recently misappropriated in a marketing campaign during a major athletic event by one of the official sponsors. Working within only a few days while the threat of an injunction was pending, our attorneys secured a substantial monetary recovery and additional compensation for our client’s participation in future campaigns.
False advertising claim dismissed. A rental car company was sued for false advertising over a mailing to consumers in California. We were able to persuade the judge to dismiss the action on novel legal theories at the outset of the litigation, avoiding time-consuming and expensive discovery.
